LuxioFlash respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512).

§1Our Commitment
LuxioFlash is a platform that hosts user-uploaded content. We respect the intellectual property rights of others and expect our users to do the same. Each user is solely responsible for ensuring that materials they upload do not infringe any third-party copyright.
In accordance with the Digital Millennium Copyright Act ("DMCA"), specifically 17 U.S.C. § 512, we will expeditiously remove or disable access to material that is claimed to be infringing upon proper notification from the copyright owner or their authorized agent.
§2Designated DMCA Agent
In accordance with 17 U.S.C. § 512(c)(2), the following is the designated agent to receive notifications of claimed copyright infringement for LuxioFlash:

§3Filing a DMCA Takedown Notice
If you are a copyright owner (or authorized agent) and believe that content hosted on LuxioFlashinfringes your copyrighted work, you may submit a written DMCA takedown notice pursuant to 17 U.S.C. § 512(c)(3). Your notice must include all of the following:
Required elements (English only — do NOT send attachments):
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work(s) claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including the specific URL(s) or file code(s) on our platform.
- Your contact information: full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a written counter-notice pursuant to 17 U.S.C. § 512(g). Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any judicial district in which LuxioFlash may be found), and that you will accept service of process from the party who filed the original DMCA notice or their agent.
Restoration Timeline
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed material.
§5Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), LuxioFlash has adopted and reasonably implements a policy for the termination of users who are repeat infringers. Specifically:
- Users who receive two (2) valid DMCA strikes will receive a formal warning.
- Users who receive three (3) valid DMCA strikes will have their accounts permanently terminated.
- We reserve the right to terminate any account at any time if we believe the user is engaging in a pattern of copyright infringement.
Terminated accounts will lose access to all uploaded content and platform features. Reinstatement is at the sole discretion of LuxioFlash.
§6Fair Use Consideration
Before filing a DMCA notice, please carefully consider whether the use of the copyrighted material at issue is protected by the Fair Use doctrine (17 U.S.C. § 107). Filing a DMCA notice when there is no infringing use may expose you to liability for damages, including costs and attorneys' fees (17 U.S.C. § 512(f)).
If you are unsure whether someone's use of your copyrighted material constitutes infringement, please consult an attorney. You may also consult publicly available reference materials at the U.S. Copyright Office or the Lumen Database.
